Searching for rental housing in 2026 first means understanding what has changed in the rules of the game.

Energy Performance Certificate (EPC) and thermal sieves: what tenants should check before signing

Most rental search guides focus on budget, neighborhood, or assembling the application. They overlook a filter that has become crucial: the energy performance of the housing.

Since January 1, 2025, properties rated G on the EPC can no longer be subject to a new lease in metropolitan France. Properties rated F will be affected starting January 1, 2028, and those rated E in 2034. Existing leases are not automatically terminated by this ban, but any new contract is blocked.

For a tenant, the direct consequence is simple: a landlord offering a property rated G in 2026 is in violation. Signing a lease on such a property exposes one to future legal actions, but most importantly, to disproportionate energy bills. Checking the EPC label even before the visit allows for the elimination of listings that should not have been published.

An order dated August 19, 2026, has also revised the coefficient applied to electricity in the calculation of the EPC. Some properties may have changed their rating recently. Asking for the date of the diagnosis and its calculation version avoids unpleasant surprises.

Rent control: comparing the advertised price to the reference rent

In areas where rent control applies (Paris, Lyon, Lille, Montpellier, Bordeaux, and other urban areas), many listings still exceed the authorized ceiling.

The mechanism is clear: each property is linked to a reference rent increased, set by prefectural order, according to the neighborhood, number of rooms, construction period, and whether the property is furnished or not. The rent excluding charges cannot exceed this ceiling, unless justified by exceptional characteristics (terrace, remarkable view, atypical ceiling height).

How to check the applicable reference rent

Each prefecture publishes the current scales. For Paris, the DRIHL website provides a simulator. For other affected cities, local rent observatories provide the grids.

  • Identify the exact geographical sector of the property (neighborhood number or reference zone according to the city)
  • Note the number of rooms, the construction date of the building, and the type of rental (unfurnished or furnished)
  • Compare the advertised rent to the increased reference rent: any unjustified excess not documented by a rent supplement is contestable
  • In case of a discrepancy, the tenant can contact the departmental conciliation commission within the first three months of the lease

This verification takes a few minutes and can represent several hundred euros in annual savings. Field feedback varies on the actual ease of obtaining a correction, but the legal framework is clear.

Frozen rents on energy-intensive properties: an unknown negotiation lever

Since August 24, 2022, rents for properties rated F or G are frozen. No increase is possible, neither during the annual revision, nor upon lease renewal, nor during a new rental, as long as the energy performance has not been improved.

For a tenant visiting a property rated F, this means that the proposed rent cannot increase for the entire duration of occupancy, unless energy renovation work is carried out by the landlord. This is a factor to consider when comparing two properties: a frozen rent on an F may be more advantageous in the medium term than a revisable rent on a D.

However, this situation creates uncertainty regarding the longevity of the lease. A landlord constrained by the 2028 deadline might choose not to renew the contract to undertake work or withdraw the property from the rental market. Asking the question during the visit helps assess the stability of the housing.

Rental application and supporting documents: legal limits to know

The pressure of the market pushes some candidates to spontaneously provide non-required documents (bank statements, employer certificates on professional behavior, ID photos). However, the list of documents that a landlord can legally request is governed by the decree of November 5, 2015.

  • Valid identification
  • Current proof of residence (rent receipts, accommodation certificate)
  • Proof of professional situation (employment contract, Kbis extract for the self-employed)
  • Proof of income (last three pay slips, latest tax notice)

The EPC, rent control, and the freeze on energy-intensive rents significantly alter the real value of a property. Checking them before committing is the part of the search that most effectively protects the budget over the duration of the lease.
